In April, the Oklahoma Court of Criminal Appeals REJECTED a request by lawyers to file an amicus brief on the circus mob atmosphere that deprived former OKC cop Daniel Holtzclaw of his rights to due process and a fair trial. Daniel Holtzclaw's Case: Ms. Tabitha Barnes now testifies, "He didn't touch me." Posted Feb. 5, 2022 Daniel Holtzclaw is a former Oklahoma City police officer wrongfully convicted in 2015 of sexual assaults and currently serving 263 years in prison for crimes he did not commit. Ms. Tabitha Barnes, one of the women who accused Daniel, now testifies, "He didn't touch me. He didn't touch me. He did not touch me. He didn't touch me," in these video excerpts from her federal civil lawsuit deposition on October 30, 2018. Ms. Barnes' deposition testimony completely contradicts her trial testimony that Daniel touched her breasts, which led to his wrongful conviction on Count 1, "Sexual Battery." Daniel is serving an 8-year prison sentence for that wrongful allegation alone. Count 1 is described as follows in the Information filed on August 29, 2014, in State of Oklahoma v. Daniel K. Holtzclaw, Case No. CF-2014-5869, in the District Court of Oklahoma County: “COUNT 1: ON OR ABOUT THE 27TH DAY OF FEBRUARY, 2014, A.D., THE CRIME OF SEXUAL BATTERY WAS FELONIOUSLY COMMITTED IN OKLAHOMA COUNTY, OKLAHOMA, BY DANIEL K. HOLTZCLAW, WHO, WHILE ACTING UNDER THE AUTHORITY OF AN OKLAHOMA CITY POLICE OFFICER, KNOWINGLY AND INTENTIONALLY TOUCHED AND IN A MANNER CALCULATED TO AROUSE AND EXCITE SEXUAL INTERESTS AND WITHOUT THE CONSENT OF T.B., TO-WIT: DIRECTING T.B.
